Copyright Infringement Policy (DMCA Compliance)
In line with the Digital Millennium Copyright Act (“DMCA”), we have adopted the following policy concerning claims of copyright violation. We reserve the right to:
-
Restrict access to, or completely remove, any material that we reasonably believe to be copyrighted content unlawfully copied or distributed by advertisers, affiliates, partners, contributors, or users of our services; and
-
Suspend or terminate services for individuals who repeatedly violate copyright.
Please note that by using ArizonaCorner’s services, you are also bound by our Terms of Service, which incorporate this Copyright Dispute Policy. Any terms used in this Policy but not otherwise defined carry the same definitions as in the Terms of Service.
Procedure for Submitting a Copyright Complaint
If you believe that any material hosted on or accessible through our Services infringes your copyright (or that of a party you represent), please submit a written notification containing the following details to our designated DMCA agent (“Designated Agent,” whose contact information is provided below):
-
A physical or electronic signature of the person authorized to act on behalf of the copyright holder;
-
Identification of the copyrighted work(s) allegedly infringed;
-
A description of the infringing material, including enough detail for us to locate it on our Services;
-
A good faith statement that the complaining party believes the use of the material is not authorized by the copyright owner, its agent, or applicable law;
-
Contact information of the complaining party, including a valid mailing address, telephone number, and, if available, an email address;
-
A statement made under penalty of perjury that the information in the notice is accurate and that the complaining party is authorized to act on behalf of the copyright owner.
Action Upon Receipt of a Valid Notice
Once a properly completed infringement notice is received by the Designated Agent, ArizonaCorner may:
-
Remove or block access to the allegedly infringing material;
-
Notify the content provider that their material has been removed or access disabled; and
-
Terminate service for the content provider in cases of repeat infringement.
Procedure for Filing a Counter-Notice
If a content provider believes that material was removed or access disabled in error (or believes they are legally permitted to use the material), they may submit a counter-notification to our Designated Agent containing the following information:
-
A physical or electronic signature of the content provider;
-
Identification of the material that was removed or disabled and its location before removal;
-
A statement made under a good faith belief that the material was removed or disabled due to mistake or misidentification;
-
The content provider’s full name, mailing address, telephone number, and, if available, email address; and
-
A statement that the provider consents to the jurisdiction of the federal court in the district where they reside, or, if outside the United States, any jurisdiction in which ArizonaCorner operates, and that they will accept service of process from the party who filed the original infringement notice.
Restoration of Material
If a counter-notice is received, ArizonaCorner may send a copy to the original complaining party. Unless the copyright owner initiates legal action seeking to prevent further use of the disputed material, the removed content may be restored or access reinstated within 10–14 business days, at our discretion.
